Objective

The purpose of the Missile Technology Control Regime (MTCR) is to assist nations in controlling missile technology and related technology that have the potential for use in development of weapons of mass destruction and associated delivery systems. The regime and supporting documentation were designed to assist in the implementation of national export controls to monitor, control, and deny exportation of these critical technologies.

Course Description

The MTCR course is designed to familiarize students with the basic guidelines of the MTCR and the MTCR review process for Foreign Military Sales (FMS) cases. A discussion of the FMS process and the relationship of the MTCR to the Arms Export Control Act (AECA) and International Traffic in Arms Regulation (ITAR) provide the students a framework for understanding the need for thorough reviews of items provided on Letters of Offer and Acceptance (LOA). The course includes a basic missile overview to assist students in understanding the general terminology, types of missiles, and components associated with controlled items on the MTCR annex. In addition, students are introduced to the roles and responsibilities of the Departments of State (DoS), Department of Commerce (DoC), and Department of Defense (DoD).   Eligibility Criteria

U.S. government employees and U.S. industry personnel are eligible. U.S. government employees defined as U.S. civilians, U.S. military, and support contractor equivalents.

  U.S. government and industry personnel should be programmed for or assigned to positions related to missile technology including services program management offices, key service acquisition personnel, Department of Defense Agencies, security assistance personnel responsible for foreign military sales cases, and U.S.contractors.

U.S. defense industry personnel. U.S. citizens and U.S. persons (as defined in the International Traffic in Arms Regulation (ITAR) Section §120.15) representing the U.S. defense industry companies are admitted on a first come, first served basis upon receipt of a request for admission. There is no course fee for U.S. industry employees with an MTCR affected position . U.S. industry personnel should submit the on-line registration form.

A SF 182 is not required for this course. Each student is required to submit a student registration application for this course.

Syllabus

The syllabus which follows is organized to reflect daily classroom activities. Each lesson is identified by title, general content, and number of classroom hours.

Day 1

Introduction to MTCR. This block of instruction is designed to provide a general overview of the MTCR and the five factors to be considered during the export decision process. An introduction to the MTCR Guidelines will highlight the member countries responsibilities in protecting items identified in the MTCR Annex. 2 hours

ITAR and FMS Process Overview. This block of instruction is designed to provide a general overview of the life cycle of a defense sale from the purchaser’s request for a defense item through the development and release of the letter of offer and acceptance. The regulatory process governing the export of classified and unclassified defense articles and services under the Arms Export Control Act (AECA) and the International Traffic in Arms Regulation (ITAR) will be discussed. Describe the roles and responsibilities of the customer and participating USG organizations in the development of the LOR/LOA. 2 hours

Overview of Missiles. This block of instruction is designed to provide a general overview of missiles and UAV’s components and operations. 2 hours

Day 2

MTCR Equipment and Technology Annex Overview. The MTCR Annex is the heart of the MTCR. The annex is a listing of all items that can be used in the development, production, operation, and testing delivery systems for weapons of mass destruction. This block of instruction will examine the construction of the annex, the two categories and the items that make up the controlled items. Following class presentation the student will perform an exercise using the annex designed to identify potential MTCR controlled items. 2 hours

MTCR Process. This block of instruction is designed to provide a discussion of the MTCR process as it relates the development of the Letter of Offer and Acceptance. Discuss the roles and responsibilities of USG organizations in the LOA review process. Identify the key activities associated with the MTCR review. 1 hour

DoS Export Controls. DoS, as an approval authority for FMS LOA cases, reviews all cases for MTCR implications. During this block of instruction the role of DoS in the MTCR review process will be discussed. LOAs with potential MTCR implications are referred to the Missile Technology Export Control (MTEC) Group for review. The Missile Technology Analysis Group (MTAG) provides assessments on foreign efforts to acquire technologies controlled by the MTCR. The responsibilities of the MTEC and MTAG in controlling proliferation of missile technology will be discussed. 1.5 hours

MTCR Exercise. Purpose of the exercise is to provide hands on practice in identification of MTCR controlled items as they may pertain to the LOA. 2 hours
